By creating an account or using StepQuest, you agree to these terms. Please read them carefully.
Use of the App
StepQuest is a walking and fitness app. You may use it for lawful personal purposes. You agree not to misuse the app, attempt to reverse-engineer it, or use it in any way that violates applicable law.
You are responsible for maintaining the security of your account. Notify us immediately at support@getstepquest.com if you believe your account has been compromised.
Eligibility
You must be at least 13 years old to use StepQuest. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these terms on your behalf. We do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us with personal information, contact us at support@getstepquest.com and we will delete it.
Outdoor Activity Risks and Safety
Walking outdoors involves real physical risks. By using StepQuest, you voluntarily assume all risks associated with outdoor physical activity, including but not limited to:
- Physical injury from falls, uneven terrain, or overexertion
- Illness or adverse health events during or after activity
- Weather-related hazards including extreme heat, cold, rain, ice, or lightning
- Traffic, cyclists, and other road users
- Encounters with animals or other environmental hazards
- Risks associated with unfamiliar neighborhoods or areas
You understand these risks and voluntarily choose to assume them. StepQuest is not responsible for any injury, illness, or harm you experience while walking a quest route.
AI-Generated Routes and Locations
This is important to understand: StepQuest uses AI to generate quest routes and recommend locations as waypoints. These locations and routes are not manually reviewed, verified for safety, or checked for current conditions before being shown to you.
Specifically:
- AI-generated location recommendations have not been verified for safety, accessibility, or legal access
- Locations may be in or near areas with hazards such as heavy traffic, active construction, restricted access, private property, or unsafe conditions
- Location data may be inaccurate, incomplete, or outdated, meaning the real-world conditions at any location may differ significantly from what the AI suggests
- The app does not represent that any location is safe to visit, legal to access, or open to the public
- The AI has no knowledge of your physical condition, your local conditions at the time of your walk, current weather, time of day, or any other factors relevant to your safety
- Location data may be drawn from third-party mapping services and databases whose accuracy we cannot warrant or verify
- Inclusion of a location as a waypoint in a quest is not an endorsement of that location, a recommendation to enter any property, or a representation that the location is appropriate for you
You are solely responsible for evaluating whether any waypoint or route is appropriate and safe for you before proceeding.
Your Safety Is Your Responsibility
You agree to take full responsibility for your own safety while using StepQuest. This includes:
- Continuously assessing the safety of your surroundings as conditions can change
- Obeying all traffic laws, pedestrian signals, and road safety rules at all times
- Respecting property access restrictions. Do not enter private property, fenced areas, or restricted locations
- Skipping any waypoint that appears unsafe, inaccessible, or inappropriate. You are never obligated to visit any suggested location
- Being aware of local conditions including weather, available daylight, area-specific risks, and your own energy levels
- Keeping your attention on your surroundings, not your phone screen, while walking
No quest is worth a safety compromise. Skip waypoints freely whenever your judgment says to.
Physical Fitness and Health
By using StepQuest, you represent that you are in sufficient physical health to participate in outdoor walking activity. You acknowledge that:
- The app does not evaluate your physical fitness, medical history, or health conditions before suggesting routes or distances
- If you have a medical condition, recent injury, or any concern about your ability to exercise safely, you should consult a qualified healthcare provider before using the app
- You should cease activity immediately and seek medical attention if you experience chest pain, shortness of breath, dizziness, severe discomfort, or any other concerning symptoms
- Walking distances and difficulty suggested by the app may not be appropriate for your current fitness level. Always adjust to what is right for you
Purchases and Subscriptions
Pro features are available via an in-app purchase processed by Apple. All purchases are subject to Apple's App Store terms. Refund requests are handled by Apple directly.
Friends and Shared Content
The friends feature lets you connect with other users and share quests. You are responsible for your interactions. Do not share content or engage in behavior that is harmful, harassing, or illegal. We reserve the right to remove content or suspend accounts that violate these terms.
Disclaimer of Warranties
The app is provided "as is" and "as available" without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that:
- Quest routes or AI-generated locations are accurate, complete, safe, or suitable for any purpose
- Route or location information reflects current real-world conditions (road closures, construction, business hours, access restrictions, etc.)
- The app will be uninterrupted, error-free, or available at any particular time
We have no duty to investigate, verify, or warrant the safety, legality, or suitability of any location suggested by the app. Inclusion of a location as a waypoint is not an endorsement of that location or a representation that it is safe or appropriate to visit.
Limitation of Liability
To the maximum extent permitted by applicable law, StepQuest and its owners, employees, and affiliates shall not be liable for any damages of any kind arising from your use of the app, including any:
- Personal injury, death, or property damage resulting from following a quest route or traveling to a recommended location
- Hazardous conditions at or near any waypoint or location suggested by the app
- Inaccurate, incomplete, or outdated location or route information
- Weather, traffic, construction, environmental hazards, or other external factors encountered while on a quest
- Physical exertion, falls, collisions, or other activity-related incidents
- Actions of third parties at any location visited as part of a quest
- Indirect, incidental, special, consequential, or punitive damages of any nature
Where applicable law does not allow the exclusion or limitation of certain liability, our liability is limited to the maximum extent permitted by that law.
Indemnification
You agree to indemnify, defend, and hold harmless StepQuest and its owners, employees, and affiliates from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to:
- Your use of the app or any quest route or location suggested by the app
- Your presence at, or travel to, any location recommended by the app
- Your violation of these Terms of Service
- Your violation of any law or the rights of any third party
Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these terms or your use of StepQuest will be resolved by binding individual arbitration under the American Arbitration Association (AAA) Consumer Arbitration Rules, not in court. By agreeing to these terms, you waive the right to a jury trial and the right to participate in any class action lawsuit or class-wide arbitration.
There is one exception: either party may bring an individual claim in small claims court if it qualifies.
If you do not want to be bound by arbitration, you may opt out by sending written notice to support@getstepquest.com within 30 days of first accepting these terms. Your notice must include your name, email address, and a clear statement that you are opting out of arbitration.
Changes to These Terms
We may update these terms from time to time. For material changes, we will provide notice through an in-app notification or a prominent notice within the app at least 14 days before the changes take effect. Continued use of the app after the effective date of updated terms constitutes your acceptance of those changes. If you do not agree with updated terms, you should stop using the app before they take effect.
Severability
If any provision of these terms is held to be unenforceable or invalid by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force and effect.
